To formalize the order, it is necessary to accept the pre-established shipping method. On our part, we will send it to you without undue delay and according to the timeframe established by the shipping provider from the date of order confirmation. And within a maximum period of 30 calendar days.
For the purposes of these Purchase Conditions, "delivery" or that the order has been "delivered" will be understood to have occurred at the moment you or a third party indicated by you acquires physical possession of the products, which will be evidenced by the signature upon receipt of the order at the agreed delivery address. The delivery time of the products will vary depending on the supplier and whether the product is already manufactured or, on the contrary, is made to order. The expected delivery time for your order is specified on each product’s page, as well as in the final step of your purchase.
If for any reason we cannot meet the delivery date, we will inform you of this circumstance and give you the option to proceed with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid. Please note that deliveries will not be made on Saturdays or Sundays.
We work with different transport companies to always offer the best service. The transportation of bulky and heavy furniture will be carried out by specialized agencies. When purchasing bulky furniture or objects with home delivery, the buyer must mention any obstacles to delivery through normal access routes (stairs, elevator, doors on the landing) in the order remarks and remind them when notified of the delivery. The buyer must verify prior to ordering, particularly regarding the product specifications in terms of size and volume, that these can be transported through the access routes to the delivery location. In the event that the furniture cannot be brought up to the customer's home by elevator or stairs, the hiring of a crane for lifting via the facade will be the customer's responsibility.
The furniture assembly option does not include mounting shelves, mirrors, bed headboards, vinyls, or generally any product that can be anchored or glued to the wall; nor does it include the assembly or installation of lamps.
The inability of demarques.es carriers or contracted agencies to deliver the products on the agreed date, in case of the buyer's absence or lack of information about the need to use specific delivery methods, may result in the payment of additional delivery costs and/or the cancellation of the order by demarques.es. The cost of this second delivery or contracting of additional services may range between 50 and 300 euros depending on the customer's address.
Due to the type of product, handling and shipping costs, as well as the risks of breakage during transport; Demarques does not make deliveries in all Spanish provinces. At the moment you enter your address in the shopping cart, you can see if your province has a delivery service.
Each product sheet indicates the available shipping methods for that item, which are detailed below:
a) Delivery by courier agency
Your order will be delivered to the street level, at the entrance door of the building or the residence indicated as the shipping address. The delivery is made by a single person and does not include access to the interior of the home, carrying the order up stairs or elevators, or placing the product inside the home.
Likewise, this service does not include unpacking the product, assembling the furniture, or removing the packaging materials, these tasks being the responsibility of the customer. This delivery method is only available for orders whose total weight does not exceed 40 kg and is carried out from Monday to Friday, without the possibility of scheduling a specific day or time slot.
For orders under €200, the shipping cost is €19.90. If the amount is over €200, the shipping cost is €29.90.
These rates are valid for the entire peninsular territory.
b) Delivery and assembly inside the room
We bring your order inside the room you indicate and assemble the furniture. This service is provided through companies specialized in furniture transport and assembly, and is available for those products that, due to their weight or assembly difficulty, require professional installation.
The transport and assembly agency will contact you to agree on the day and time slot for delivery and assembly, at least one day in advance of the scheduled delivery date of the order. The delivery will be made by two people, who will be responsible for unpacking the product, assembling the furniture, and removing the generated packaging (boxes, cartons, plastics, etc.).
This service does not include the installation or mounting on walls of headboards, shelves, mirrors, or other elements, nor the electrical connection of lamps or wall lights. For safety reasons, no drilling will be done on walls or ceilings.
Deliveries are made from Monday to Friday.
For deliveries in the Community of Madrid, this service is free for orders with an amount equal to or greater than €750. If the order amount is less than this amount, the service cost will be €69.90.
For deliveries in the rest of the provinces of the peninsular territory, the service cost will be €109.90 for orders with an amount less than €1,000. For orders with an amount greater than €1,000, the service cost will be €99.90.
In case delivery cannot be made due to the recipient's absence, the shipping agency will leave a notice and will try to contact the recipient by phone. After two (2) unsuccessful attempts, you must contact the shipping agency to arrange delivery.
There are different procedures for making exchanges, returns, and withdrawals. Below, we describe the characteristics of each, as well as their costs and conditions.
a. Exchange: an exchange is considered the replacement of one product with another from the store. Shipping costs will be borne by the customer.
b. Return under warranty: in case of defect or fault. Shipping costs will be borne by the company.
All products to be exchanged or returned must be properly packaged, preferably in their original packaging.
If upon receiving the order you have doubts about the chosen size or for any reason decide to exchange the product, contact us via email at info@demarques.es or through the contact methods we provide on the Website.
You can exchange any product as long as it is in perfect condition, unused, and with all its tags, packaging, and, if applicable, original documentation and accessory elements that came with it. After receiving your request, we will contact the shipping agency to pick up the product (you may hand over the product in the same box in which you received it). In the case of an exchange, the carrier delivering the new chosen product will be the one to collect the product to be returned.
The amount of the exchange (or the difference in amount in case of an exchange for another product of lesser value) will be refunded using the same payment method you used to make the purchase. If you do not follow these instructions, we reserve the right to refuse the refund.
When making a return, we will refund you the value of the Order and the shipping costs, but you must bear in mind that depending on the place of shipment, return shipping costs may apply. Additionally, if you want to keep part of the Order, we will not refund the shipping costs.
The refund will be made using the same payment method you used to place the Order. Our goal is to process the refund as soon as possible and, at the latest, within 14 days from when we receive the returned items. If you have not received the refund within this period, please contact us and we will assist you.
When making a return, we will refund the full amount of any item in an Order provided it has not been damaged, soiled, washed, altered, or used in any way that has reduced the value of the item. Please return the item using and including all its original packaging, instructions, and other accompanying documents, if any.
You have the right to withdraw from this contract within fourteen (14) calendar days without any justification.
The withdrawal period will expire fourteen (14) calendar days after the delivery of the purchased product, from the day you or a third party indicated by you, other than the carrier, acquired physical possession of the goods or, in the case that the goods that make up your order are delivered separately, fourteen (14) calendar days from the day you or a third party indicated by you, other than the carrier, acquired physical possession of the last of those goods.
To exercise the right of withdrawal, you must expressly notify EL RASTRILLO DEL MARQUES 22 S.L. in writing either by postal mail to the address C. Fernández de los Ríos nº 52, 28015 - Madrid or by writing to the email info@demarques.es, clearly expressing your unequivocal decision to withdraw from the contract.
To withdraw, you may use the withdrawal form template provided as a link at the end of these Terms of Purchase as Annex I, although its use is not mandatory. To meet the withdrawal deadline, it is sufficient that the communication regarding your exercise of this right is sent before the corresponding period has elapsed.
In the event of withdrawal by you, we will refund all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive ordinary delivery method we offer) without undue delay and, in any case, no later than 14 calendar days from the date we are informed of your decision to withdraw from this contract. We will proceed to make such reimbursement using the same payment method used by you for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not incur any costs as a result of the reimbursement.
We may withhold reimbursement until we have received the goods, or until you have provided proof of return of the goods, whichever condition is met first. You must return or deliver the goods directly to us at (insert the name and address of the company, if applicable, of the person authorized by you to receive the goods), without undue delay and, in any case, no later than 14 calendar days from the date you notify us of your decision to withdraw from the contract. The deadline is considered met if you return the goods before the period has expired. You must bear the direct cost of returning the goods.
You will only be responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. In the case of a contract for the provision of services, insert the following: "If you have requested that the provision of services begin during the withdrawal period, you will pay us an amount proportional to the part of the service already provided at the time you notified us of your withdrawal, in relation to the total object of the contract."

In any case, we will proceed to the immediate removal of any link when the content to which it redirects may contravene national or international law, morality, or public order. We have adopted, and will continue to adopt, all necessary measures within our possibilities and the state of technology to ensure the proper functioning of the Website and to prevent the existence of harmful components. The seller will be liable to the consumer for defects that appear within a period of three years from delivery, which will be understood as the day indicated on the invoice or purchase receipt, or on the delivery note if this is later.
Unless proven otherwise, it will be presumed that the non-conformities manifested within two years following the delivery of the good already existed when it was delivered. The fulfillment by EL RASTRILLO DEL MARQUES 22 S.L. of all or part of its obligations shall be suspended in the event of a fortuitous event or force majeure that prevents or delays compliance. Such events shall be considered, in particular, without this list being exhaustive: war, riots, insurrection, social unrest, strikes of any kind, and supply problems not attributable to it.
EL RASTRILLO DEL MARQUES 22 S.L. will inform the client of the occurrence, if applicable, of a fortuitous event or force majeure within seven (7) days of its occurrence. In the event that such suspension extends beyond a period of fifteen (15) days, the client will then have the option to terminate the ongoing order and a refund will then be processed under the conditions set forth in point 6 of these General Terms and Conditions of Purchase.
