Access to the Website grants you the status of ‘User’, understood as anyone who uses the Website for the purpose of obtaining information about our establishment and the services offered, to register on the Booking platform, or to make a Booking or contract a service (hereinafter, a ‘Booking’ or the ‘Services’, respectively).

We recommend that you read these Terms of Use carefully before making a Reservation. The use of the Website or making a Reservation by any User implies full acceptance of these Terms of Use, the Privacy Policy and Cookies, and the Legal Notice, which are available at the bottom of the Website.

If you have any questions related to the Terms of Use, the Privacy Policy and Cookies or the Legal Notice, you can contact us through our usual contact channels, and if you do not agree with them, we ask that you leave this page and do not make any Reservation. If you make a Reservation on behalf of a company, you should know that it will be bound by the same.

The Website is free and open access; however, making a Reservation may require prior subscription or registration on the Website. Additionally, some sections may require you to fill out a form or make a payment beforehand, as explained later.

promptly maintain and update this information so that it remains true, accurate, current, and complete.

If we have reasonable grounds to suspect that such information does not meet the above criteria, we reserve the right to suspend or cancel your account and to deny you current or future use of the Website. The processing of personal data you provide to us through the registration form is governed by our Privacy and Cookies Policy and Cookies.

In any case, according to the law, as a Client, you must show upon arrival at the establishment a valid and current official photo identification document (National Identity Document or Passport).

2.3 Limitations on Use of the Website

Make a Reservation or contract a Service if you are under 18 years old.
Perform actions that could alter, damage, interrupt, or harm our electronic systems or those of third parties; as well as not obstruct other users' access to the Website and its services by massively consuming the computing resources through which we provide our services.

3. RESERVATIONS

3.1 Making a reservation

You can make Reservations through the Website, for which it is necessary that you accept these Terms and Conditions, as well as the Privacy Policy and Cookies, and the Legal Notice.

3.2 Conditions for Modifying or Canceling a Reservation

If you want to change the Reservation date or the number of guests, we will do our best to accommodate your request as long as there is availability. You can request the modification or cancellation by contacting us using any of the contact methods indicated in the Customer Service section.

If you do not show up on the Reservation date without having modified or canceled it as indicated in this clause, it will be considered a late cancellation and we may apply the penalty or retain the deposit payment that we informed you of when booking.

4. PRICE AND PAYMENT

4.1 Prices

The applicable prices are those indicated at any given time on the Website on the date the Reservation is made and include VAT and any other applicable indirect tax. We may update the prices at any time, but changes will not affect Reservations already confirmed.

If a tourist tax or fee is applicable, we will inform you of its amount before confirming the Reservation; unless otherwise indicated, it is paid directly at the establishment.

4.2 Payment Methods

To make a Reservation or contract a Service, you must provide a payment method. The Website may redirect you to third-party platforms to complete the payment of the Reservation by credit card or other available payment methods.

Payment method providers or issuers may adopt anti-fraud measures that result in the rejection of certain types of transactions over which we have no control, so MAS D'EN BOSCH, S.A. is not responsible for the application of such security policies.

You can modify your payment methods through your account or by contacting us using any of the contact methods indicated in the Customer Service section. After each update, if it is a recurring purchase, you authorize us to continue charging you through the relevant payment method.

4.3 Invoicing

When making your purchase, you have the right to receive a paper invoice free of charge. If you wish to receive it in electronic format, you only need to expressly authorize it by checking the corresponding box or notifying us through any of our Customer Service channels.

You can revoke this consent at any time by contacting us through the same Customer Service channels, without any cost to you.

4.4 Exclusion of the Right of Withdrawal

You should know that the right of withdrawal does not apply to Reservations: these are accommodation services for purposes other than serving as housing, with a specific date or period of execution. This does not affect the modification and cancellation policy of clause 3.2 nor the other rights granted to you by law. The gift voucher (clause 3.3) is governed by the provisions indicated in its own clause.

4.5 Promotions and Discounts

At MAS D'EN BOSCH, S.A., we may launch promotional campaigns or apply discounts on our products or services at any time. These campaigns will be available during the period expressly indicated in the promotion itself or while they remain published on our website.

Unless otherwise stated, promotions and discounts are for one-time use only, non-cumulative, and subject to availability. At MAS D'EN BOSCH, S.A., we reserve the right to cancel any order if we detect an obvious error in the published price or misuse, fraudulent use, or violation of the promotion conditions.

We will attend to you and respond as soon as possible and, in any case, within a maximum period of one month from the submission of your inquiry or complaint.

Upon receiving your complaint, we will provide you with an acknowledgment of receipt with an identification code and a written or durable medium receipt.

If your complaint is not resolved through our customer service, we will inform you about the competent alternative consumer dispute resolution entities, without prejudice to your right to appeal to consumer authorities or courts.

We have official complaint forms available that you can request at the establishment or through our Customer Service channels.

6.1 Regarding Information

At MAS D'EN BOSCH, S.A., we allow Users who have made a Reservation or contracted the Services to share their experience through reviews, ratings, and comments (hereinafter, the “Reviews”). These Reviews aim to help other Users make informed decisions.

By submitting a Review, you expressly accept these Terms of Use, the Legal Notice and the Privacy Policy and Cookies, and declare that:

You are of legal age.
You are the original author of the content or have the necessary authorizations for its publication.
The Review reflects a real personal experience, either your own or from people in your environment for whom you have authorization to share such experience.
You have not received any payment, gift, discount, or other compensation in exchange for posting the Review. We do not publish purchased or incentivized reviews. If a review comes from a commercial collaboration, it will not be shown as a consumer opinion and will be clearly and unequivocally identified as promotional content.
The content does not infringe the rights of third parties (including copyright, image rights, data protection, trade secrets, or the right to honor).

Contain offensive, defamatory, threatening, discriminatory, sexist, racist language or incite hatred or violence.
Include advertising, spam, links, prices, external comparisons, or other commercial purposes.
Contain viruses or potentially harmful technical elements.
Refer to topics unrelated to the Reservation or the Services evaluated, such as payment or charge issues, cancellations, refunds, or other incidents that must be processed through the enabled contact channels.
Contain personal data of any kind or sensitive data according to Article 9 of Regulation (EU) 2016/679 (such as health, beliefs, sexual orientation, etc.).
Constitute attacks on other Users or other Reviews.

Although we may correct spelling or formatting errors that do not alter the content, as well as remove personal data included by mistake, we will publish both positive and negative Reviews that meet these requirements and under the same moderation criteria. Likewise, you may publish only one Review per each Reservation or contracted Service.

7.2. Verification and Publication of Reviews

We apply reasonable and proportionate measures to verify that the Reviews come from people who have actually made a Reservation or contracted the Services. To do this, we check that each Review corresponds to an effectively made Reservation, through the confirmation number, the email linked to the contract, or another technical validation mechanism. Reviews that pass this check may be displayed as verified, indicating the verification method applied.

Reviews may come from those who have made a Reservation or contracted a Service directly on MAS D'EN BOSCH, S.A. or from third-party websites, in which case their origin may be indicated.

Once published, we will inform you about the criteria used to determine their order of appearance, which will be based on objective parameters such as the publication date, relevance, or usefulness. Under no circumstances will the original content or rating be modified.

7.3 Rights of Use over Reviews

By submitting a Review, you grant us a free and non-exclusive license to use, reproduce, adapt, translate, publicly communicate, or distribute the Review, in any medium or format, including websites, social networks, commercial communications, points of sale, and, in particular, also for advertising or promotional purposes.

8. MISCELLANEOUS PROVISIONS

8.1 Intellectual and/or industrial property

The design of https://www.bergaresort.com as well as the databases, software (including source code), the various elements that make up the website (texts, graphics, photographs, videos, sound recordings, color combinations, etc.), as well as the distinctive signs (logos, registered trademarks, and trade names) appearing therein are the property of Mas d'en Bosch, S.A or the license holders and are protected by the corresponding intellectual and industrial property rights.

Under no circumstances does the use of the Website or the contracting of the Services imply the transfer of any intellectual and/or industrial property rights over it or its contents.

8.2 Force majeure

In the event of a fortuitous event or force majeure that prevents or delays the fulfillment of the Services, we may be obliged to suspend our obligations in whole or in part. Such events shall include, without limitation: war, riots, insurrection, social unrest, strikes of any nature, and supply problems not attributable to us.

If a fortuitous event or force majeure occurs, we will inform you without undue delay. In the event that such suspension lasts longer than 20 days or if it becomes evident that we will not be able to comply, you will have the option to cancel the Reservation and a refund will then be processed under the conditions set forth in these Terms of Use.

8.3 Modification of the Terms of Use

These Terms of Use were last updated on 03/08/2026. We may review and update these Terms of Use at any time and will notify you by the usual means, but whenever they affect material elements, they will not take effect until 14 days after publication.

In any case, the Terms of Use in effect at the time of making each Reservation will apply, and no subsequent modification will affect Reservations already made.

8.4 Independence and integrity of the clauses

The illegality, invalidity, or ineffectiveness of any of the clauses forming these Terms of Use will not affect the validity of the rest, provided that the rights and obligations are not essentially affected. Such clauses shall be replaced or supplemented with others that, being in accordance with the law, fulfill the purpose of the replaced ones.

8.5 Applicable law and jurisdiction

Access to and use of https://www.bergaresort.com shall be governed by Spanish law. Any dispute or controversy shall be resolved by the courts and tribunals of Berga with express waiver of any other jurisdiction that may correspond to you, except in the case that you are considered a consumer, in which case the courts and tribunals of your domicile shall have jurisdiction.
