These Purchase Conditions govern the acquisition of items through the website https://elpasticcino.com (hereinafter the "Website") through which El Pasticcino sells and advertises our products.

Access to the Website grants you the status of "User," understood as anyone who uses the Website for the purpose of obtaining information about the items offered, to register, or to place an order (hereinafter, an "Order").

4.1 Amounts

Unless otherwise stated, promotions and discounts are for one-time use only, not combinable with each other, and subject to availability. At El Pasticcino, we reserve the right to cancel any order if we detect an obvious error in the published price or misuse, fraud, or violation of the promotion conditions.

When we announce a price reduction, the lowest price we have applied to that product during the 30 days prior to the start of the promotion will be indicated alongside the discounted price.

5. SHIPPING

5.1 Shipping Methods

To complete your order, you must confirm the selected shipping method. We will do our best to deliver your Order within the indicated timeframe for the chosen shipping method and, in any case, within a maximum period of 30 calendar days from the confirmation of the Order.
During high demand periods, such as sales or special campaigns, or due to logistical or weather-related incidents, delivery may be delayed; if this happens, we will inform you as soon as possible. If we do not deliver on time, you may require us to do so within an additional reasonable period and, if we also fail to deliver within that period, cancel the Order, in which case we will refund you without undue delay all amounts paid.

5.2 Deliveries

For the purposes of these Purchase Conditions, delivery or that the order has been delivered will be understood to have occurred at the moment you or a third party authorized by you acquires physical possession of the products, which will be evidenced by the signature of receipt of the order at the agreed delivery address.

In case delivery is not possible due to the recipient's absence, the shipping agency will contact you by the usual means to inform you of the next steps to enable delivery.

6. RETURNS AND WITHDRAWAL.

6.1 Returns due to withdrawal

Changed your mind? No problem. In accordance with European Union consumer protection legislation, you have the right to withdraw from all or part of your Order, without needing to state the reason, within 14 calendar days from the date you or a third party authorized by you receive the products.

6.2 Refunds

When making a return exercising your right of withdrawal, we will refund all amounts received, including ordinary delivery costs, if any. Additional costs arising from choosing a delivery method other than the most economical ordinary method we offer will not be refunded. Also, if you withdraw only part of the Order, shipping costs will not be refunded.

We will proceed with the refund within a maximum period of 14 calendar days from the moment you inform us of your decision to withdraw. However, we may withhold the refund until we have received the Order or until you provide us with proof of its return, whichever occurs first; at that time, we will make the refund without delay. We will do so using the same payment method you used to place the Order and at no cost for the refund, unless you expressly indicate otherwise. If you have not received it within this period, please contact us and we will assist you.

Remember that you will only be responsible for the decrease in value of the products resulting from handling other than what is necessary to establish their nature, characteristics, or functioning. In other words: you can examine the item as you would in a physical store, but if you return it used, damaged, or incomplete, we may deduct from the refund the amount corresponding to that loss of value. To avoid this, we ask that, whenever possible, you return the item with all its original packaging, instructions, and other accompanying documents.

6.3 Exceptions

The right of withdrawal does not apply to products that:

6.4 Returns of defective items

6.5 Issues with fresh products

Due to their perishable nature, fresh products are excluded from the right of withdrawal, as indicated in the Exceptions section. This does not affect your right to receive them in good condition.

If the Order arrives in poor condition, incomplete, or different from what was requested, please contact us as soon as possible, preferably within 24 hours of delivery so that we can verify the issue. Once the issue is verified, we will proceed with the replacement of the product or the refund of the amount, and the corresponding return shipping costs will be borne by us.

We ask that whenever possible, you check the Orders at the time of receipt so that in case there is any issue you can contact us as soon as possible and we can provide you with a solution.

At El Pasticcino, we allow Users who have placed an Order to share their experience through reviews, ratings, and comments (hereinafter, the “Reviews”). These Reviews are intended to help other Users make informed decisions.

By submitting a Review, you expressly accept these Purchase Conditions, the Legal Notice and the Privacy Policy, and you declare that:

• You are of legal age.
• You are the original author of the content or have the necessary authorizations for its publication.
• They refer to products purchased or used within the previous 30 days.
• The Review reflects a real personal experience, either your own or from people in your environment for whom you have authorization to share such experience.
• You have not received any payment, gift, discount, or other compensation in exchange for submitting the Review. We do not publish purchased or incentivized reviews. If a review comes from a commercial collaboration, it will not be shown as a consumer opinion and will be clearly and unequivocally identified as promotional content.

• They constitute attacks on other Users or other Reviews.

Although we may correct spelling or formatting errors that do not alter the content, as well as remove personal data included by mistake, we will publish both positive and negative Reviews that meet these requirements and under the same moderation criteria. Likewise, you may publish only one Review per Order placed.

10. MISCELLANEOUS PROVISIONS

10.1 Force Majeure

In the event that a fortuitous event or force majeure occurs that prevents or delays the fulfillment of our obligations, we may be forced to suspend your Order in whole or in part. Such events shall include, without limitation: war, riots, insurrection, social disturbances, strikes of any kind, and supply problems not attributable to us.

If a fortuitous event or force majeure occurs, we will inform you without undue delay. If such suspension lasts more than 20 days or it becomes evident that we will not be able to fulfill the order, you will have the option to terminate the current Order and a refund will then be processed under the conditions set forth in these Purchase Terms.

10.2 Independence and Integrity of the Clauses

The illegality, invalidity, or ineffectiveness of any of the clauses forming these Purchase Terms shall not affect the validity of the rest, provided that the rights and obligations are not essentially affected. Such clauses shall be replaced or supplemented by others that, being in accordance with the law, fulfill the purpose of the replaced clauses.

10.3 Modification of the Purchase Terms

These Purchase Terms were last updated on 31/07/2026. We may review and update these Purchase Terms, notifying you by the usual means; when the modification affects substantial elements, it will not take effect until 14 days after its publication. In any case, each Order shall be subject to the Purchase Terms in effect at the time of its placement, and no subsequent modification will affect Orders already placed.

10.4 Governing Law and Jurisdiction

Access to and use of https://elpasticcino.com shall be governed by Spanish law. Any dispute or controversy shall be resolved by the courts and tribunals of Dénia, with express waiver of any other jurisdiction that may correspond to you, except in the case where you are considered a consumer, in which case the courts and tribunals of your domicile shall have jurisdiction.
