In this article, we provide everything you need to know to comply with the regulation.<\/p>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">What is the right of withdrawal?<\/h2>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>The right of withdrawal is defined as the consumer\u2019s unilateral right to cancel a distance contract without having to justify their decision and without incurring any penalty. It is a inalienable right; therefore, any contractual provision that restricts this right or imposes a penalty for exercising it is null and void.<\/p>\n\n\n\n<p>The general period for exercising the right of withdrawal is <strong>14 calendar days<\/strong> from receipt of the goods, or from the conclusion of the contract in the case of services. However, if the trader fails to properly inform and document this right before the purchase, the withdrawal period is automatically extended to 12 months. Therefore, it is important to properly inform customers about their right of withdrawal in order to apply the standard 14-day period.<\/p>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Who does the withdrawal button apply to?<\/h2>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>One of the most common questions raised by this new obligation is determining which businesses are actually required to incorporate a withdrawal button into their online contracting processes.<\/p>\n\n\n\n<p>The answer is that this obligation applies to distance contracts concluded online whenever European legislation grants consumers a right of withdrawal.<\/p>\n\n\n\n<p>The requirement to provide a withdrawal button is introduced through Directive (EU) 2023\/2673, which amends Directive 2011\/83\/EU on consumer rights. Although this legislation is primarily focused on financial services contracts, the measure is not limited to such contracts. This solution usually simplifies management and reduces compliance risks.<\/p>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">What Has Changed?<\/h2>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>The right of withdrawal was already recognized under existing legislation, but the new development is the mandatory implementation of a direct, visible, and simple technical mechanism that allows consumers to exercise this right.<\/p>\n\n\n\n<p>Under the previous Directive, consumers already had the right to change their minds and withdraw from a contract, but it was sufficient for businesses to inform consumers of this right within their legal documentation. Therefore, the button must be visible and easy to locate without disproportionate effort, for example, within the customer account area, order history section, or website footer.<br><br><\/li>\n\n\n\n<li><strong>Clear and Unambiguous Labeling<\/strong><br>The withdrawal button must be labeled using clear terms that leave no doubt as to its purpose. Expressions such as \u201cExercise Right of Withdrawal,\u201d \u201cWithdraw from Purchase,\u201d or \u201cCancel Online Contract\u201d are highly recommended. The use of ambiguous or creative wording that reduces the user\u2019s ability to understand the effect of the action constitutes a breach of information obligations.<br><br><\/li>\n\n\n\n<li><strong>Prohibition of Dark Patterns<\/strong><br>The design of the user interface is now subject to Regulation (EU) 2024\/1689, which prohibits the use of manipulative or deceptive techniques intended to substantially influence user behavior.<br>This includes prohibiting practices such as confirmshaming (using language that makes users feel guilty for withdrawing) and the roach motel pattern (making the cancellation process significantly longer or more complex than the sign-up process).<br><br><\/li>\n\n\n\n<li><strong>Universal Accessibility<\/strong><br>The design of the button must pay special attention to consumers in vulnerable situations. For this reason, information and rights-exercise mechanisms must be provided in formats that ensure accessibility.<br>This means that the button must be compatible with screen readers, provide sufficient contrast, and use a font size that complies with legal readability standards (a minimum height of 2.5 millimeters).<br><br><\/li>\n\n\n\n<li><strong>Documentary Confirmation<\/strong><br>As soon as a consumer exercises their right of withdrawal, the company must immediately acknowledge receipt of the request. This confirmation may be provided through a notification on the website itself, but it must also be supplemented by a receipt on a durable medium, such as a confirmation sent to the user's email address.<br><br><\/li>\n\n\n\n<li><strong>Free of Charge<\/strong><br>The exercise of the right of withdrawal must not entail any cost for the consumer. Therefore, any technical costs arising from the implementation and maintenance of the withdrawal functionality must be borne entirely by the trader.<br><br><\/li>\n\n\n\n<li><strong>Management of Exceptions<\/strong><br>Not all products are eligible for withdrawal. The system must be capable of determining when this right does not apply (for example, in the case of customized goods, products that deteriorate or expire rapidly, or sealed goods that are not suitable for return for health or hygiene reasons once unsealed).<br>In such cases, instead of displaying the withdrawal button, the system must provide clear and prior information explaining why, in that specific situation, the consumer will lose their right of withdrawal if they proceed with the purchase.<br><br><\/li>\n\n\n\n<li><strong>Integration with the Refund Process<\/strong><br>Activating the withdrawal button must trigger a process that guarantees the reimbursement of all amounts paid by the consumer, including the original delivery costs, within a maximum period of 14 calendar days.<br>The refund must be made using the same payment method that the consumer used for the initial transaction, unless the consumer expressly agrees otherwise.<br><br><\/li>\n\n\n\n<li><strong>Inclusion in Legal Documentation<\/strong><br>The implementation of a withdrawal button also requires a review and update of the legal documentation on your e-commerce website.<br>The general terms and conditions, returns policy, and pre-contractual information provided to consumers must clearly inform them about the existence of the withdrawal button, its location, and how it can be used.<br>Therefore, it is not sufficient merely to make the button available on the website. The company must expressly communicate its existence and explain how consumers can exercise this right, ensuring that they have all the necessary information both before and after entering into the contract.<\/li>\n<\/ol>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">What Happens if the Withdrawal Button Does Not Comply with the Regulations?<\/h2>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>Spanish consumer protection legislation not only recognizes the right of withdrawal but also penalizes businesses that hinder or prevent its effective exercise.<\/p>\n\n\n\n<p>In this regard, the penalty regime established in the Consolidated Text of the General Law for the Protection of Consumers and Users (TRLGDCU) distinguishes between various types of infringements that may be particularly relevant when a company implements a withdrawal button or a digital cancellation procedure.<\/p>\n\n\n\n<p>On the one hand, Article 47 provides for several infringements related to obstacles imposed on consumers seeking to terminate a contractual relationship. In particular, subsection (k) refers to limitations or barriers that businesses may impose when consumers attempt to terminate or end a contract. This provision may apply where the withdrawal process is excessively complex, difficult to access, or clearly more burdensome than the contracting process itself.<\/p>\n\n\n\n<p>However, where the trader's conduct directly affects the exercise of the right of withdrawal, subsection (s) of the same Article 47 appears to be more appropriate, as it specifically sanctions the refusal, obstruction, or unjustified hindrance of this right.<\/p>\n\n\n\n<p>This may include situations where the consumer cannot locate the withdrawal button, is required to complete unnecessary steps, receives discouraging or misleading messages, or fails to receive effective confirmation of their request.<\/p>\n\n\n\n<p>The distinction is significant, as the TRLGDCU assigns a different level of seriousness to each type of infringement.<\/p>\n\n\n\n<p>Accordingly, infringements falling under the first category are classified as minor infringements. By contrast, conduct involving the obstruction of the right of withdrawal is classified as a serious infringement, reflecting the importance that the legislature places on protecting this fundamental consumer right.<\/p>\n\n\n\n<p>This difference in classification directly affects the applicable penalties.<\/p>\n\n\n\n<p>Minor infringements may be sanctioned with fines ranging from <strong>\u20ac150 to \u20ac100,000<\/strong>. Furthermore, where the offender has obtained an economic benefit from the unlawful conduct, the fine may be increased to an amount equivalent to between two and four times the unlawful profit obtained.<\/p>\n\n\n\n<p>Serious infringements may result in fines ranging from <strong>\u20ac10,001 to \u20ac100,000<\/strong>. These amounts may also be exceeded where they are insufficient to eliminate the economic advantage gained, reaching up to an amount equivalent to between four and six times the unlawful profit generated by the infringement.<\/p>\n\n\n\n<p>These penalties must also be considered in light of European consumer protection legislation.<\/p>\n\n\n\n<p>Under the <strong>Omnibus Directive<\/strong>, Member States are required to establish effective, proportionate, and dissuasive penalties for widespread infringements of consumer law. In particular, the maximum penalties must amount to at least 4% of the trader's annual turnover in the Member State or Member States concerned, or \u20ac2 million where information on turnover is not available.<\/p>\n\n\n\n<p>For this reason, from a compliance perspective, it is not enough merely to formally include a withdrawal button on a website or application.
