(Exception: Authorized therapeutic purposes).<br><br><strong>Generic Social Scoring: <\/strong>Evaluation of social behavior that results in discriminatory treatment.<br><br><strong>Real-Time Remote Biometric Identification:<\/strong> Prohibited in public spaces. (Exception: Strict use by authorities for public security and criminal prosecution).<br><br><strong>Facial Scraping:<\/strong> Non-selective extraction of facial images from the internet or CCTV to create databases.<br><br><strong>Emotional State Assessment: <\/strong>Systems that infer emotions in employment, educational, border management, or criminal law enforcement contexts.<\/td><td><strong>Forbidden<\/strong><\/td><\/tr><tr><td><strong>High Risk<\/strong><\/td><td>Systems with the potential to significantly affect health, safety, environment, or fundamental rights.<\/td><td><strong>Regulated<\/strong>:<br><br><strong>Risk Management: <\/strong>Iterative and continuous process throughout the entire lifecycle.<br><br><strong>Data Governance: <\/strong>Training of models with high-quality and integrity data.<br><br><strong>Technical <\/strong>Documentation: Intelligible manuals that demonstrate regulatory compliance.<br><br><strong>Event Logging: <\/strong>Traceability of security and operability.<br><br><strong>Transparency for Users: <\/strong>Design that enables interpretation of output information.<br><br><strong>Human Oversight: <\/strong>Monitoring by trained natural persons to prevent risks.<br><br><strong>Cybersecurity: <\/strong>Resilience and accuracy by design and by default.<\/td><\/tr><tr><td><strong>Limited class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>Article 13 establishes a mechanism for reporting serious incidents to the Personal Data Protection Agency, with a maximum deadline of 72 hours from when the operator becomes aware of the causal link between the system and the incident.<\/p>\n\n\n\n<p>These serious incidents are defined as those that cause death, serious harm to health, disruption of critical infrastructure, violation of fundamental rights, or environmental damage.<\/p>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Institutional Framework: Governance and Supervision<\/h2>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>For governance and regulatory compliance, the bill is based on two oversight bodies:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Technical Advisory Council on AI<\/strong>: A consultative body whose functions include proposing the list of high-risk and limited-risk systems, advising on the scope of applicable rules, and proposing guidelines for controlled testing spaces.<\/li>\n\n\n\n<li><strong>Personal Data Protection Agency<\/strong>: It is tasked with supervision and the exercise of sanctioning authority, leveraging the fact that the operation of any AI system is based, precisely, on data processing.<\/li>\n<\/ul>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Fostering Innovation<\/h2>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>The bill is not limited to restricting but rather dedicates an entire section to support measures, among which the following stand out:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Controlled Testing Spaces (Sandboxes):<\/strong> Environments supervised by state bodies that allow innovative AI systems to be tested before commercialization, with exemption from administrative fines, although not from civil liability, if the agreed plan is respected.<\/li>\n\n\n\n<li><strong>Measures for Small Enterprises:<\/strong> Priority access to sandboxes, digital training programs, and participation in the Advisory Council through the Small Business Advisory Council.<\/li>\n<\/ul>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Infractions, Penalties and Civil
