Does it affect you?<\/h2>\n\n\n\n<p>On <strong>February 2, 2025<\/strong>, the European Union took a historic step by implementing the<strong> first bans<\/strong> under the <strong>Artificial Intelligence<\/strong> (AI) <strong>Act<\/strong>.  At<strong><a href=\"https:\/\/lawwwing.com\/\" data-type=\"link\" data-id=\"https:\/\/lawwwing.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"> Lawwwing<\/a><\/strong>, we\u2019ll tell you how they might affect you.<\/p>\n\n\n\n<p>The EU\u2019s Artificial Intelligence Act is considered groundbreaking as it is the world\u2019s first comprehensive regulation establishing a specific and binding legal framework for AI, positioning Europe as a global leader in the field.<\/p>\n\n\n\n<p>These bans aim to ensure the ethical and, above all, safe use of <strong>AI<\/strong>, protecting the <strong>fundamental rights<\/strong> of European citizens.<\/p>\n\n\n\n<div style=\"height:40px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">What are these bans and who do they affect?<\/h2>\n\n\n\n<p>If a company wants to use AI in the workplace or suspects it is already doing so, it will need to be cautious about how it applies the technology. Here are some of the<strong> key bans<\/strong> that companies must now comply with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>AI can not be used to <strong>recognize emotions<\/strong> in the workplace when <strong>biometric recognition <\/strong>tools are involved. For example, a system that analyzes articles to detect the author's tone would not be prohibited since it does not use biometric data. However, an AI system that identifies the author of an article based on their keystroke patterns would be banned.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>AI-powered devices or applications can not use <strong>subliminal techniques<\/strong> to <strong>influence people\u2019s behavior<\/strong>, <strong>exploit vulnerabilities, or classify individual<\/strong>s. For example, using chatbots to impersonate family members in order to manipulate someone\u2019s response is now prohibited.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>AI can <strong>not be used<\/strong> for biometric <strong>identification of individuals<\/strong> in when done in public spaces and remotely.<\/li>\n<\/ul>\n\n\n\n<p>In addition to these bans, AI providers and those deploying AI systems must ensure their teams have the necessary <strong>knowledge and skills <\/strong>to properly use and manage AI, as stated in the regulation.<\/p>\n\n\n\n<p>These bans impact <strong>all businesses<\/strong>, but some industries will be affected more than others. So far, the most impacted sectors include <strong>security and analytics companies, sports organizations, and human resources<\/strong> firms, which may need to rethink their workflows.<\/p>\n\n\n\n<div style=\"height:40px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">What happens If you don\u2019t comply?<\/h2>\n\n\n\n<p>The penalties for non-compliance are serious! Companies violating these bans could face fines of up to <strong>\u20ac35 million<\/strong>. If who fails the ban is a business, the fine will be <strong>7% of its global annual income<\/strong> from the previous financial year, depends on which amount is higher.<\/p>\n\n\n\n<p>In other words, if 7% of a company\u2019s worldwide revenue exceeds \u20ac35 million, the fine will be 7% of its revenue. If not, the penalty will be \u20ac35 million. The Spanish AI Supervisory Agency (<strong>AESIA<\/strong>) will be responsible for enforcing these fines.<\/p>\n\n\n\n<div style=\"height:40px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">What\u2019s next?<\/h2>\n\n\n\n<p>Although the AI Act officially came into force on August 1, 2024, it <strong>won\u2019t be fully applicable<\/strong> (with all its restrictions) until <strong>August 2, 2026<\/strong>. However, as often happens, there are exceptions. Let\u2019s take a look!:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>As mentioned earlier, the bans and AI literacy obligations have been in effect since <strong>February 2, 2025.<\/strong><\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Governance rules and obligations for <strong>general-purpose AI models<\/strong> won\u2019t apply until <strong>August 2, 2025<\/strong>. These are AI systems trained on massive datasets that can perform a wide range of tasks (e.g., ChatGPT).<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Public administrations:<\/strong> Compliance will start in <strong>August 2026<\/strong>, with full adoption required by their suppliers by 2030.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>High-risk AI systems<\/strong>: those that could serious threats to<strong> health, safety, or fundamental rights<\/strong> have an extended transition period until<strong> August 2, 2027.<\/strong><\/li>\n<\/ul>\n\n\n\n<div style=\"height:40px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Why do we need AI regulations?<\/h2>\n\n\n\n<p>The new AI Act proves that Europe is determined to<strong> lead in AI regulation<\/strong>. This is crucial for the European market because while many AI systems minimal risk and help solve complex problems, others introduce risks that must be managed to prevent harmful consequences.<\/p>\n\n\n\n<p>With the increasing adoption of AI, we must be sure it is used<strong> ethically and responsibly.<\/strong> These new rules not only protect consumers but also businesses, guaranteeing that <strong>AI<\/strong> is used fairly, <strong>transparently, ethically, and safely.<\/strong><\/p>\n\n\n\n<p>Interested in this topic?
