Spain has taken an important step to protect users from unwanted commercial calls. Starting June 7, 2025, companies can no longer make advertising calls from mobile numbers or from hidden or unassigned numbers. This measure, part of a broader strategy against fraud and telephone harassment, seeks to strengthen consumer rights and put an end to invasive practices that, until now, were all too common.<\/p>\n\n\n\n

What does this new regulation entail?<\/h2>\n\n\n\n

According to Order TDF\/149\/2025, commercial calls may only be made from numbers identifiable as:<\/p>\n\n\n\n

  • Geographic numbers (landline prefix)<\/li>\n\n\n\n
  • Toll-free 800 or 900 numbers<\/li>\n\n\n\n
  • Specific codes assigned by operators<\/li>\n<\/ul>\n\n\n\n

    The goal is to eliminate the use of mobile phones in commercial campaigns, thus making spoofing more difficult.<\/p>\n\n\n\n

    Official data on blockades<\/h2>\n\n\n\n

    Since March, carriers have been blocking suspicious calls and text messages. In just three months:<\/p>\n\n\n\n

    • More than 14 million fraudulent calls were blocked<\/li>\n\n\n\n
    • More than 10,000 fraudulent SMS messages were identified and stopped daily<\/li>\n<\/ul>\n\n\n\n

      These figures show the extent of the problem and the need for effective regulation.<\/p>\n\n\n\n

      Key legal changes<\/h2>\n\n\n\n

      1. Termination of contracts without consent
        From now on, any contract without express and verifiable consent will be considered void. Companies must renew their consent every two years.<\/li>\n\n\n\n
      2. Differentiated prefixes for commercial calls
        Promotional and customer service calls must use different prefixes. Failure to respect this distinction will result in operators being required to automatically block the call.<\/li>\n\n\n\n
      3. Fines for non-compliance
        Penalties can reach up to 2 million euros for serious violations, such as:\n

        • Calling without consent<\/li>\n\n\n\n
        • Insisting after a previous block<\/li>\n\n\n\n
        • Formulating invalid contracts<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n

          Origin of these measures<\/h2>\n\n\n\n

          These actions are part of the reform of the Customer Service Law (SAC Law), promoted by the Ministry of Social Rights, Consumption, and the 2030 Agenda. Although the ban on calls without consent has been in place since 2023, loopholes that allowed abusive practices have now been closed.<\/p>\n\n\n\n

          And what's happening in Europe?<\/h2>\n\n\n\n

          Spain aligns itself with countries like Finland, France, and Germany, which have already implemented similar regulations. For example, in Finland, telephone scams decreased by 90% after a similar law went into effect.<\/p>\n\n\n\n

          What about commercial SMS?<\/h2>\n\n\n\n

          For now, promotional SMS messages are still permitted, but with imminent restrictions. In 2026, the CNMC (National Commission for Consumer Protection) will activate a national database to validate SMS sender information, reducing text message fraud.<\/p>\n\n\n\n

            • Use landline numbers (geographical prefixes)<\/li>\n\n\n\n
            • Contract a virtual switchboard with a landline number<\/li>\n\n\n\n
            • Use 800 or 900 lines for customer service<\/li>\n\n\n\n
            • Request short numbers authorized by the CNMC<\/li>\n<\/ul>\n\n\n\n

              Note: This rule only applies to calls and text messages. WhatsApp and business email communications are not affected\u2026 yet.<\/p>\n\n\n\n
